Terms of Service

These Terms of Service ("Terms") govern your use of WiserBuild at wiserbuild.com (the "Site"). WiserBuild is operated by AACI Group, Inc. ("AACI Group," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

AACI Group operates several homeowner wildfire tools, including Home Hardening Score, Defensible Space Score, Wildfire Action Plan, WildfireList, and WiserBuild. The same Terms apply on each of them.

1. Who can use the Site

You must be at least 18 years old and able to form a binding contract. If you use the Site on behalf of an organization, you confirm that you have authority to bind it. The Site is intended for use in the United States.

2. What the Site is, and what it is not

The Site provides information and self-service tools about wildfire preparedness, home hardening, defensible space, and finding help with that work. Scores, ratings, reports, plans, and recommendations are based on the information you give us and on public data, and they can be incomplete or wrong.

They are not:

• an inspection, certification, or engineering assessment of any property;
• legal, insurance, financial, or other professional advice; or
• a prediction or guarantee that any home will survive a wildfire, or a guarantee of insurability, coverage, pricing, discounts, or any insurance decision.

Always follow instructions from fire officials and emergency authorities, and never delay an evacuation because of anything on the Site.

3. Information you give us

You agree that the information you provide is accurate to the best of your knowledge, and that you have the right to share any photos or documents you upload. You keep ownership of what you submit. You give us a non-exclusive, worldwide, royalty-free license to use, store, and process it to provide and improve our services, as described in our Privacy Policy. We may also use information in aggregated or de-identified form that no longer identifies you.

4. Accounts and saved work

Some tools let you save your work, return to it through a private link, or create an account. Keep your login details and private links confidential. You are responsible for activity under your account. Tell us promptly if you think your account or link has been used without your permission.

5. Insurance connections

AACI Group also owns Five Bays Insurance Agency, a licensed insurance agency (California Department of Insurance license 6016871). Some tools offer an optional link to Five Bays. Using it is your choice and is separate from using the Site. Requesting a policy review or a quote is not an application and does not guarantee coverage, pricing, or eligibility. Insurance services are provided only by Five Bays, under its own terms. If you buy a policy through Five Bays, it may earn a commission.

6. Contractors, suppliers, and other businesses

Some tools list or connect you with independent contractors, suppliers, and other businesses. They are not our employees, agents, or partners, and we do not supervise their work. A listing is not an endorsement or recommendation, and it is not a guarantee of any business's licensing, insurance, quality, price, or results. Information on a listing may come from the business itself. Check licensing and insurance and get written estimates before you hire anyone. Any agreement you make is between you and that business.

When you send an inquiry, we share your details with the businesses you choose, as our Privacy Policy explains. Some links to products or services may be affiliate links, and we may earn a commission if you buy through them, at no extra cost to you.

7. Third-party sites

The Site links to websites and services we do not control. We are not responsible for their content, availability, or practices, and their own terms and privacy policies apply when you use them.

8. Acceptable use

You agree not to:

• use the Site for any unlawful, harmful, or fraudulent purpose;
• interfere with the Site's operation or security, or try to access it in an unauthorized way;
• use bots, scrapers, or other automated means to access or copy the Site or its data, beyond ordinary search engine indexing;
• upload malicious code, or content you do not have the right to share; or
• impersonate anyone or misrepresent your relationship with anyone.

We may suspend or block access for anyone who breaks these rules.

9. Our content and your feedback

The Site and its content, including software, text, scores, methods, graphics, logos, and design, belong to AACI Group or its licensors and are protected by law. We give you a limited, revocable, non-exclusive, non-transferable license to use the Site for your own personal or internal business purposes under these Terms. You may not copy, sell, or redistribute the Site or its content without our written permission. If you send us feedback or ideas, we may use them without any obligation to you.

10. Messages from us

We send you the messages you ask for, such as your report, plan, or replies to your questions. We send marketing email only where you have agreed to receive it, and every marketing email includes a way to unsubscribe.

11. Disclaimer of warranties

The Site and everything on it are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on it is complete, accurate, or current.

12. Limitation of liability

To the fullest extent permitted by law, AACI Group and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or property, arising from or related to your use of the Site or reliance on its content. Our total liability for any claim relating to the Site will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid us for the Site in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless AACI Group and its affiliates, officers, employees, and agents from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of another person.

14. Suspension and termination

We may suspend or end your access to the Site at any time if we believe you have violated these Terms or the law, or for security or operational reasons. You may stop using the Site at any time. Sections that by their nature should survive, including sections 9, 11, 12, 13, and 15, survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction and venue. Nothing in these Terms limits any right you have under consumer protection or privacy laws where you live.

16. Changes to these Terms

We may update these Terms. When we do, we publish the new version here with a new version number and effective date. Changes apply from that date and do not apply to a dispute that arose before it. Continuing to use the Site after a change takes effect means you accept the updated Terms.

17. General

These Terms, together with our Privacy Policy and any notices on the Site, are the entire agreement between you and AACI Group about the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or sale of assets. There are no third-party beneficiaries.
